What is the SBRP?

The SBRP initiative commenced on 1 January 2021 with the intention of allowing directors to access a Small Business Restructuring Practitioner to maximise their business’ chance of surviving and continuing to trade and employ.

Upon the appointment of a Small Business Restructuring Practitioner, creditors cannot take action against a company, nor can a personal guarantee be enforced against a director.

A restructuring plan is developed by the company’s director/s with the support of the practitioner within 20 business days. The practitioner certifies the plan based on their assessment of the company’s financial affairs.

Directors will remain in control of the business and continue operating.

Creditors vote on the restructuring plan within 15 business days of receipt. Approval of the plan requires a majority of unrelated creditors in value to respond by the deadline.

If a majority of creditors vote in favour of the restructuring plan, the plan is commenced and the practitioner is appointed to oversee the plan.

Adam is the Managing Director of Integra Restructuring & Insolvency.  He is an ASIC Registered Liquidator and a Chartered Accountant with over 14 years’ experience in the insolvency industry. He has worked in both Sydney and Melbourne on a number of corporate and personal appointments. These include trade-on appointments and liquidations with complex legal matters. 
 
Adam aims to assist clients with companies that are in financial distress and formulate strategies to achieve the best outcome for all stakeholders. He also consents to act as liquidator for petitioning creditors who have applied to wind-up companies who have failed to pay outstanding debts.

Who is eligible for the SBRP?

Business must be operating in an incorporated entity (a company) (sole traders and partnerships are not eligible).

The company’s business must still be trading (continuing operations).

All outstanding employee entitlements must be paid (includes wages and superannuation).

All ATO tax returns and BAS lodgements must be submitted and up to date.

The company must have less than $1,000,000 (one million) in debt.

The company and its directors cannot access the Restructuring or Simplified Liquidation processes more than once in the last 7 years.

Unfortunately, your company does not qualify.

The Small Business Restructuring Process is only available to companies that are trading.

Question 3: Are all employee entitlements paid (including superannuation)?

Can your company’s outstanding employee entitlements be paid in full prior to commencing the SBRP?

Unfortunately, your company does not qualify.
